Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") are a legal agreement between you (the "Store Owner," "you," or "your") and Naveed Sajid, a sole proprietor operating as Notify CRM ("Notify CRM," "we," "us," or "our"), based in Pakistan. By installing, activating, or using the Notify CRM plugin or any related service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not install or use the Service.

If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of the Service

Notify CRM is a WooCommerce plugin and companion licensing service that helps store owners manage order statuses, send branded transactional emails, and send WhatsApp order notifications to their own customers, including through Meta's WhatsApp Business Platform (Cloud API) via Meta's Embedded Signup. Notify CRM acts as a Meta Tech Provider, giving store owners a way to connect their own WhatsApp Business Account to the plugin. Some features are available on a free plan; additional features are available on paid plans described at hustletoevolve.com/notify-crm/pricing.

3. Eligibility and account registration

• You must be at least 18 years old and have the legal capacity to enter into a binding contract.
• You must operate a legitimate WooCommerce store and have the right to send order communications to your own customers.
• To connect WhatsApp features, you must have (or be authorized to manage) a WhatsApp Business Account and a Meta Business Account, and you must comply with Meta's own terms for those products.
• You are responsible for the accuracy of the information you provide during registration and for maintaining the security of your WordPress admin account and Notify CRM license.

4. License to use the plugin

Subject to these Terms, Notify CRM grants you a limited, non-exclusive, non-transferable, revocable license to install and use the plugin on WooCommerce websites that you own or operate, for your own internal business purposes. You may not resell, sublicense, reverse engineer (except as permitted by applicable law), or remove proprietary notices from the plugin. The plugin's free components are also distributed under the GPLv2 (or later) license, consistent with WordPress.org plugin directory requirements; where the GPL and these Terms differ regarding the licensed code itself, the GPL governs the code, and these Terms govern your use of our hosted services, paid features, and support.

5. Plans, billing, and cancellation

• Free plan — core features are available at no cost, for as long as we choose to offer them.
• Paid plans (Starter, Growth, Business, Agency) — unlock additional features such as automated Cloud API sending, abandoned cart recovery, broadcast campaigns, analytics, and team inbox, as described on our pricing page.
• Payment processing — paid subscriptions are billed through Lemon Squeezy, our merchant of record, who handles payment collection, taxes, and invoicing on our behalf. Your use of Lemon Squeezy's payment services is also subject to Lemon Squeezy's own terms.
• Billing cycle — paid plans renew automatically on the billing cycle you select (monthly or annual) until cancelled.
• Cancellation — you may cancel a paid plan at any time from your account dashboard; cancellation takes effect at the end of the current billing period, and your plan will revert to the free tier afterward.
• Refunds — unless required by applicable law, fees already paid are non-refundable; refund requests are reviewed on a case-by-case basis and may be granted at our discretion within 14 days of purchase.
• We may change our pricing with reasonable advance notice; continued use after a price change takes effect constitutes acceptance of the new pricing for future billing periods.

6. Acceptable use

You agree that you will not use the Service to:

• Send WhatsApp or email messages to individuals who have not consented to receive order-related communications from your store;
• Send spam, unsolicited marketing, or messages unrelated to a customer's own order, except through features specifically designed for opted-in marketing (such as Broadcast Campaigns), and only in compliance with Meta's WhatsApp Business Messaging Policy;
• Transmit unlawful, defamatory, obscene, or fraudulent content;
• Violate any applicable law, including data protection and consumer protection laws in the jurisdictions where your customers are located;
• Attempt to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Service or our servers;
• Use the Service to build a competing product using our code, branding, or infrastructure.

We may suspend or terminate access for violations of this section, particularly where a violation risks our relationship with Meta or our WhatsApp Business Platform access.

7. WhatsApp / Meta Platform compliance

Because Notify CRM operates as a Tech Provider on Meta's WhatsApp Business Platform, you agree that:

• You are solely responsible for obtaining proper consent (opt-in) from your customers before sending them WhatsApp messages, and for honoring opt-outs;
• You will comply with Meta's WhatsApp Business Messaging Policy and Meta's Platform Terms at all times when using WhatsApp features of the Service;
• Meta may suspend your WhatsApp Business Account or phone number for policy violations independent of Notify CRM, and we are not responsible for actions taken by Meta;
• We may need to share limited account or usage information with Meta where required to investigate suspected policy violations or to maintain our Tech Provider status.

8. Your data and privacy

Our collection and use of information in connection with the Service is described in our Privacy Policy. You are responsible for complying with applicable privacy and data protection laws with respect to your own customers' data, including obtaining any consents required to send them order-notification messages. As between you and Notify CRM, you remain the data controller for your customers' personal data; Notify CRM acts only as a service provider carrying out your instructions (e.g., sending a message you configured, using data read directly from your own WooCommerce store).

9. Intellectual property

Notify CRM and its licensors retain all rights, title, and interest in and to the Service, including all software, trademarks, and content, except for the GPL-licensed plugin code as described in Section 4 and except for your own store data and content. You retain all rights to your store data, templates, and content you create using the Service.

11. Limitation of liability

To the maximum extent permitted by applicable law, Notify CRM and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us for the Service in the 12 months preceding the claim, or USD 100 if you are on the free plan.

12. Indemnification

You agree to indemnify and hold harmless Notify CRM and its owner from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of Meta's policies, or your violation of any law or third-party right, including the rights of your own customers.

13. Termination

You may stop using the Service and delete the plugin at any time. We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, if required to comply with a legal obligation, or if continued access would jeopardize our relationship with Meta or other partners. Upon termination, your right to use the Service ceases immediately; provisions that by their nature should survive (including Sections 9–12 and 15–16) will survive termination.

14. Changes to the Service or these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be reflected by updating the "Last updated" date above, and, where appropriate, by additional notice (such as an in-plugin notice or email). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Lahore, Punjab, Pakistan, except where applicable consumer-protection law in your own country grants you the right to bring a claim in your local courts.

16. General provisions

• Entire agreement — these Terms and the Privacy Policy constitute the entire agreement between you and Notify CRM regarding the Service.
• Severability — if any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• No waiver — our failure to enforce any right or provision is not a waiver of that right.
• Assignment — you may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force majeure — we are not liable for delays or failures due to causes beyond our reasonable control, including outages of third-party services such as Meta's WhatsApp Business Platform.
