These Terms of Service ("Terms") are a legal agreement between you (the "Store Owner," "you," or "your") and Naveed Sajid, a sole proprietor operating as Notify CRM ("Notify CRM," "we," "us," or "our"), based in Pakistan. By installing, activating, or using the Notify CRM plugin or any related service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not install or use the Service.
If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
Notify CRM is a WooCommerce plugin and companion licensing service that helps store owners manage order statuses, send branded transactional emails, and send WhatsApp order notifications to their own customers, including through Meta's WhatsApp Business Platform (Cloud API) via Meta's Embedded Signup. Notify CRM acts as a Meta Tech Provider, giving store owners a way to connect their own WhatsApp Business Account to the plugin. Some features are available on a free plan; additional features are available on paid plans described at hustletoevolve.com/notify-crm/pricing.
Subject to these Terms, Notify CRM grants you a limited, non-exclusive, non-transferable, revocable license to install and use the plugin on WooCommerce websites that you own or operate, for your own internal business purposes. You may not resell, sublicense, reverse engineer (except as permitted by applicable law), or remove proprietary notices from the plugin. The plugin's free components are also distributed under the GPLv2 (or later) license, consistent with WordPress.org plugin directory requirements; where the GPL and these Terms differ regarding the licensed code itself, the GPL governs the code, and these Terms govern your use of our hosted services, paid features, and support.
You agree that you will not use the Service to:
We may suspend or terminate access for violations of this section, particularly where a violation risks our relationship with Meta or our WhatsApp Business Platform access.
Because Notify CRM operates as a Tech Provider on Meta's WhatsApp Business Platform, you agree that:
Our collection and use of information in connection with the Service is described in our Privacy Policy. You are responsible for complying with applicable privacy and data protection laws with respect to your own customers' data, including obtaining any consents required to send them order-notification messages. As between you and Notify CRM, you remain the data controller for your customers' personal data; Notify CRM acts only as a service provider carrying out your instructions (e.g., sending a message you configured, using data read directly from your own WooCommerce store).
Notify CRM and its licensors retain all rights, title, and interest in and to the Service, including all software, trademarks, and content, except for the GPL-licensed plugin code as described in Section 4 and except for your own store data and content. You retain all rights to your store data, templates, and content you create using the Service.
To the maximum extent permitted by applicable law, Notify CRM and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us for the Service in the 12 months preceding the claim, or USD 100 if you are on the free plan.
You agree to indemnify and hold harmless Notify CRM and its owner from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of Meta's policies, or your violation of any law or third-party right, including the rights of your own customers.
You may stop using the Service and delete the plugin at any time. We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, if required to comply with a legal obligation, or if continued access would jeopardize our relationship with Meta or other partners. Upon termination, your right to use the Service ceases immediately; provisions that by their nature should survive (including Sections 9–12 and 15–16) will survive termination.
We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be reflected by updating the "Last updated" date above, and, where appropriate, by additional notice (such as an in-plugin notice or email). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Lahore, Punjab, Pakistan, except where applicable consumer-protection law in your own country grants you the right to bring a claim in your local courts.
